Question Hi Terry, I saw you answer some similar questions about uninsured auto accidents and I just wanted to see if I could get some more clarifications. I live in Washington State, and was at-fault for an accident and didn't have insurance. I make a very minimal amount of money[hence the lack of insurance] and already have a number of things I need to pay to survive[food, housing, etc] things that are non-negotiable. I talked to a lawyer[not specifically a bankruptcy lawyer] but she suggested that I did talk to one. Then the next day I called the other person involved in the accident insurance company and they told me that if I filed for bankruptcy that my license would be suspended until I paid off the debt. I did my best to research online but am getting some mixed signals. This accident would be the only reason my license would be suspended. So if you could try and help me get some straight answers I would definitely appreciate it.
Answer Absent a state law otherwise, once the bankruptcy is filed, the suspension will release because the debt is discharged in the case (Assuming no DUI etc) The state may charge a reinstatement fee to get the license back. But they cannot keep the suspension until the debt is paid once you file bankruptcy.
