Bankruptcy Law - Bankruptcy Ch 13

Expert: Mark J. Markus- California Bankruptcy Attorney - 9/25/2009

    Question
Thank you Mr. Markus for being available for questions!
Is there anything I can do to resolve my Ch 13 case asap.
2 yrs ago I filed ch 13,sold my house, became full time student while making the trusty payments. I have 10 months to go but have a job offer that will not move forward if I have an open ch 13 case. I am able to pay the 10 months that are left in advance, but was told it would not close the case until the 10 months is up and only if I do not have a change in income. I was also told I would not get a hardship discharge for being a student because the trusty knows I sold my house under the ch 13.

    Thanks again,
    Chris

    Answer
Well, assuming what you've been told is accurate in your jurisdiction, the only way you can "resolve" your CH. 13 case is to dismiss it.  Of course by doing that, you will not get a discharge of your debts.   Perhaps you need to find out more about why your job offer won't go forward if you have an "open" ch. 13 case.  What is the basis for that?  Maybe that way you can construct a better plan of attack.
