Bankruptcy Law - Ch 13 dismissal and my credit report

Expert: Mark J. Markus- California Bankruptcy Attorney - 9/23/2009

    Question
I have had a Ch 13 dismissed due to non pay because I became unemployed. Now that I am back working and trying to get
re-established, I am having a very very hard time. Of course, the creditors are coming after me now especially in reference to my vehicle. I dont know if I need refile or just let them get the car back and then I try to get another vehicle.

I also would like to know if there is a way for me to get this dismissal off of my credit report if I choose not to re-file? I make enough money now to not refile but my issue is trying to get another vehicle.

    Answer
Unfortunately, no you cannot get the Ch. 13 filing off your credit report because you did file it.  The credit report should note that it was dismissed, so that can always work to explaining things when you're trying to get a loan.
