Question
I have had a Ch 13 dismissed due to non pay because I became unemployed. Now that I am back working and trying to get
re-established, I am having a very very hard time. Of course, the creditors are coming after me now especially in reference to my vehicle. I dont know if I need refile or just let them get the car back and then I try to get another vehicle.

I also would like to know if there is a way for me to get this dismissal off of my credit report if I choose not to re-file? I make enough money now to not refile but my issue is trying to get another vehicle.

Answer
The fact that you filed the bankruptcy will stay on your credit report for 10 years, even if it was dismissed. Nothing will change that.  You can shop around to get another car, but it will be up to the lenders if they want to qualify you for a loan. Check the ads in the papers, many say bankruptcy OK.  Refiling may be an option for you to consider.
