Question
Hello,

I filed in San Francisco, CA....I am currently in Chapter 13, i think? I'm repaying a 100.00 a month for a year and half now, but now am going through some major medical issues, where my doctors pulled me from work and im applying for SSI in PA where I live now. Is there a way to get the bankruptcy dismissed if im approved by SSI, since i wont be able to work...I have a neurological disorder and may never be able to work again???

Thanks,
Greg B

Answer
If you cannot afford to make your monthly Chapter 13 payment then your case will be dismissed. Your trustee will bring a motion to dismiss your case and have the case dismissed. You should look at whether at this time you qualify for Chapter 7 bankruptcy if you can no longer afford to make your Chapter 13 bankruptcy payments. You should talk to an attorney to determine whether you can have your case converted to a Chapter 7 bankruptcy, given your change in income. If you need any further information please contact me at:
