Question
If you had one bankruptcy, can you file again and how long in between?

Answer
If you have a chapter 7, you must wait 8 years from the filing date to file another chapter 7.  If you have a prior 13, there is no timeline for waiting. You can file at any time, any chapter.  If you have a prior ch7 and want a ch13 now, you can only get a discharge in the new case if it has been 4 years since the first case.
