Question
My wife filed bk in utah a month ago.2 weeks prior took out 401k loan for $9000 with no real proof where the money went....except some bills and to help my mother in south america. Is the discharge compromised.   required to pay that money?  thanks

Answer
She is required to show any such transfers (e.g. to her mother) on Statement of Financial Affairs question 10.   I doubt this will be a problem, since the money she transferred would otherwise have been exempt from the bankruptcy anyway.   As long as she can show the money was taken as a loan from her 401k, I don't think anyone will care, but it really depends on the Trustee and Judge in her case.
