Question
If you sign a contract with an attorney to provide Chapter 7 bankruptcy services and pay the amount stated in the contract can the attorney call you and ask for more money because your case is taking too much time?  No written request, just a verbal phone call.  The additional fees requested are 38% of the original fee.
There is no reference in the contract that there may be additional fees.

Answer
This would depend on what was agreed to in the contract initially. If you signed a contract agreement with the attorney for services, it should have included the scope of the services that the fees were for. If the attorney is trying to charge you additional fees that were within what was previously agreed to in the contract, you should seek to enforce the terms of the contract. You should not be charged additional fees if the contract agreement included the services that the attorney is now performing and there was no reference to additional fees for those services.
