"Good day
With reference to bankruptcy of a business or a distressed business, I have heard that it is possible for an investor to buy the assets of the business at a fraction of the market value. For example if the business assets are valued at $10,000, someone can buy it at $1000.
I dont know if this is true but if it is can you shed some insights into how this is possible. Also are there any examples and if so how come did other investors not run the price up.
Is this possible and if so please let me know how."

As a Los Angeles Bankruptcy Attorney for 34 years, I have handled many cases where assets have sold by a bankruptcy trustee. The assets I have dealt with includes real estate, jewelry, accounts receivable, equipment, and just about everything else you can think of.

This is a very good bankruptcy question, and something I know many people wonder about. I am glad to share my bankruptcy experience and advice with you.

The law requires that bankruptcy assets must be sold at the best price obtainable. Bankruptcy trustees work very diligently to obtain the highest, best price for assets that they sell. Any suspicion of an insider deal will be investigated. Any lack of integrity shown by any officer in a bankruptcy proceeding will bring instant dismissal of everyone involved. There is one former Los Angeles Bankruptcy Trustee who is in prison. One of his crimes was that he employed his daughter as his real estate agent for selling bankruptcy assets, (conflict of interest), and then took kick backs from her, (highly illegal).

MR. BAYER SAYS: The big banks and credit card companys have been working overtime for many years to undermine the Consitutional right of the American people to be able to claim bankruptcy protection. In 2005 the banking lobby successfully convinced Congress and the President to make the laws and proceedures more complicated, hopeing that it will stymie legitimate people from filing bankruptcy. They succeeded in gaining these complex new legal proceedures by greasing the legislative system with hundreds of millions of dollars in "campaign contributions." The good news for the American people is that while the new laws have made the proceedures needlessly complex to the point where inexperienced people can't help but trip over the maze of new rules and regulations, the process is still doable, especially with a lawyer who is well trained and experienced in this specialty.
