Question
I FILED A CHAPTER 13 9 YEARS AGO AND IT WAS DISMISSED. I JUST BARELY REC'D A COLLECTION LETTER ON A 9 YR OLD DEBT. I WAS WONDERING WHAT THE LAWS ON TIMELY COLLECTION IF ANY? DO I NEED TO PAY BACK THIS DEBT 9 YEARS LATER?

Answer
If your case was dismissed, then you did not eliminate the debt.  If your case was discharged and you scheduled the debt, you can give the creditor a copy of the discharge to clear it out.  

A creditor can collect on a debt if the debt was renewed.  Several events can toll the statute of limitations on collections.  Perhaps you should consider a chapter 7 or file another chapter 13 depending on your current situation.
