Question
Two question's.  1st. My husband and I have filed chapter 13 and we go to court on Jan 29, 08.  We have already been given a trustee and first payment is due on Jan 06, 08.  My question is when I file my tax return and if I have a refund we'll I have to report that?  2nd. My home owner dues are past due and if it's not paid they we'll put a lien on my home, should I file my owner dues in my chapter 13 or not?

Answer
1.  That depends on the rules of your jurisdiction, but usually tax refunds must be included in your plan.

2.  I don't know what you mean by "file."  If you are past due on your HOA dues, they have a claim against your estate and they must be listed as a creditor.
