Question
I am recently going through a divorce and we have the arrearage on the mortgage in bankrupcty and I am still having a hard time paying the arrears that is in bankrupcty and the monthly rent, is there any way we can put the entire mortgage in bankruocty and if not is there any way we can avoid foreclosure

Answer
If your case is filed, then you cannot put any recent default into the case.  You have to stay current with the mortgage company.  If you are falling behind, perhaps you can work out a forbearance agreement with the lender.  Otherwise, you may want to consider refinancing, or selling the property entirely.
