Question
Hi i was told by my florida lawyer that by filing ch. 13(instead of 7) i would be able to keep my next tax return check..is this true in any sense? i don't qualify for7..

Answer
Your chapter 13 can be designed to protect all assets, including tax refunds.  Say you are paying 100% of the debt with prime rate interest, then that usually flies.  In Chicago, the Trustee doesn't take tax refunds, but each jurisdiction differs, so I would listen to your lawyers advice.
