The description of the tithes were not man's ordinances, nor were they only to be given every three years. They were the Lord's and they were every year.

Leviticus 27, the chapter begins with "Leviticus 27:1-2 (ESV)

1  The LORD spoke to Moses, saying,

2  “Speak to the people of Israel and say to them…

And in Numbers 18:1 (ESV)

1  So the LORD said to Aaron...

Also in Deuteronomy 1:3 (ESV)

3   ...Moses spoke to the people of Israel according to all that the LORD had given him in commandment to them...

These are 3 places where the legislation of the tithes were described. These scriptures tell a different story and give different instructions than what you relay in your letter/question to the pastor back in 2007. A more accurate summary is this;

The tithe was to be given every year.  There was a special tithe, that was for the care of the poor and needy (including the Levite) was to be taken every third year.

Each year the Jew was to take the tithe to Jerusalem and there partake of the tithe with the levites from within their gates (home city), and the Levite would own what was left. Out of what was left, the Levite would take a tenth, the best tenth, and would give it to the priest. But in the Third year the Jew would remain at their home and would invite the Levite and the needy of their community, and they would partake together.  What was left over was the Levite's, to be used for himself and kind of as a fund for caring for the needy.

I encourage you to examine the Bible text for yourself and you will see that while some details can be confusing, two things are clear, it was the Lord who Spoke to Moses and Aaron to give the instructions and the instructions included giving the tithe every year (with special instructions for the third year's tithe).

You can find them in:Leviticus 27:30-33, Numbers 18:21-32, and Deut. 12:5-6, 11, 18.
