Question
Scenario: 1 out, tie game in the bottom of 9th, runners on 2nd & 3rd. The batter hits a fly ball to the outfield. The runner on 3rd tags and crosses the plate beating the throw. The runner on 2nd leaves before the ball is caught and does not return to 2nd. The catcher then throws the ball to the 2B who steps on 2nd before that runner tags. Is the game over when the run crosses the plate or is this a double play without the winning run scoring?

This is what we call a timing play. If the run crosses the plate prior to the third out being made, then the run scores. This is not a force play, and therefore, the run would count as long as it happened prior to the out.
