Question
My question relates to 8' step ladders. Are there rules regarding the use of a step ladder on a construction site? Can one lean a step ladder against a building or must it be opened? And if leaned must it be tied down to the structure?

Marty, this sounds like this issue may be headed for some type of legal interpretation.  Every tradesman I know has leaned his portable (step) type ladder against the wall and done some type of work.  If the OSHA man were on site, I'm sure he would write it up because the ladder did not have 4 point contact.  The tie off requirement has more to do with leaving the ladder to access some other surface like the roof.

I don't know on which side of the issues you stand, but for all the laws on ladder usage, OSHA would prevail.  Here is a site that gives you a link to the OSHA laws and some interesting job stories about ladders:
