Business Debt/Partner wrote bad checks

Question
I am a member of a LLC and have a business partner. My partner wrote a $4400 check that bounced. The lawyer of the contractor receiving the check is now threatening me with fines and criminal charges even though my partner signed the check; which I was unaware of. Is there any chance that I could be kept out of this and not face the penalties? I am learning he has done this in the past (unfortunately I am now just learning of his history). Thank you.

Answer
James:
Thank you for your inquiry. Your partner (you as an officer) or the company may be subject to be reported to the County District Attorney office and be asked to pay restitution on reported checks. It is a crime to pass bad checks, and if convicted it is punishable in some states by imprisonment and fines. I am not an attorney and can not give legal advice, therefore I strongly recommend you seek legal counsel to advise you of your rights or liability to this claim. You can visit www.findlaw.com, www.lawyers.com or www.lawhelp.org to get the name of an attorney in your area. Good luck.
