Question I started a home based business about 3 years ago. The
busness was healthcare. I lived n the house with my fiance
so when I applied for the business licence they put my fiance's name on the EIN request. He NEVER HAD ANYTHNG DO with my busness...ever.
Three weeks ago get a SUMMONS in HIS NAME,,,wth my business on the summons....sung me for a debt of $67,000.00
for medical equipmment. Half of the materal was damaged and returned. How do respond to ths SUMMONS? He s nnocent, he never sgned nor ordered ANYTHNG....I DiD. Help me....

Based on the information you provided, it would appear that the creditor (plaintiff) has your fiances name as a responsible party for the debt. You did not provide detail as to the status of the business or what was done to remedy the outstanding debt prior to this. You seem to have returned goods for credit, and if you were credited properly should have reduced your liability. I believe at this point the best you can do is gather up all your records in regards to this payable and go hire an attorney to sort this all out. You may have a legitimate reason or dispute as to the claim or the fact that your fiance was not an officer of the business.
