Business Debt/Judgment Collection from Credit Card Client

Question
Hi, Michelle –

We’re a business with a small claims court judgment against another business that previously used our services and paid by credit card.  Normally, we would move to collect by filing an information subpoena against the customer’s bank, but this customer only paid us by credit card during their term of service – no checks were issued to us.  We have the original credit card number (which has since expired or cancelled), a signed contract, and a signed credit card authorization agreement with the firm.  Do you have any suggestions for how we might freeze their assets based on the info we have, or otherwise collect this judgment?  Thank you.


Answer
If you have already obtained a judgment, file with the same court for periodic payments. This will get you a hearing where a judge will order specific payments to be made on specific dates and if they violate that court order, they can be held in contempt of court. Also, if you have a judgment go back to the court and tell them you want to attach their bank account or assets and get the necessary paperwork to do that.
