Question My mom took over a small restaurant business earlier this year and have been managing it with a company that she and her partner started. Just today, she recieved a letter from a collection agency stating that her restaurant owes Sprint PCS money. My mother did what she thought was the right thing to do and called the collector immediately. The collector told her that the debt was occured in 2004 but since she took over the business, she assumes the responsibility for paying this bill. Since 2004, the restaurant have changed managements twice and this is the first time that she's heard of this debt.
Is my mom is liable for this debt or not? And if not, what does she need to do next?
Thanks so much.
Answer Yuna:
Thank you for your inquiry. While I appreciate you mothers position and desire to respond, I am not in a position to provide legal advice. I would suggest that you speak to an attorney to verify that none of the previous owners debts were assumed or transferred to her if not disclosed. I wish you the best in resolving this matter.
Respectfully,
Christine Janklow
