Question
I have made a modification that I am not sure meets code.  Does the home inspection done as part of the sale process serve as a validation that the modification is okay?  Does this indemnify me?  What is the best way for me to be sure I am safe from liability?

Thank you for your good question…

I don’t know which state you are located, but in most states there is a law regarding disclosure. As long as you disclose all items that may have an effect on the desirability of you home to a potential buyer, you should not have any liability problems with the buyer. In order to make a claim against you, the buyer would have to prove that you fraudulently did not disclose what ever situation they may find after the close of escrow. Give the buyer every opportunity to inspect the home with a licensed contractor only. The contractor will be their personal agent for the inspection taking the responsibility off your shoulders for items that you had no knowledge of during your ownership of the property and that he had missed on his inspection.

As mentioned, full disclosure is the key to your question. Don’t hesitate to talk with your Realtor regarding this issue as he/she will have full knowledge of your responsibilities when it comes to disclosure. Good Luck…
