Buying or Selling a Home/Property Disclosure

Question
Is a property disclosure required to sell a church (has not been used as a church in years)?

Also, is an attorney required to sell a property in NYS?

Answer
Dear Donna,

Thank you for your question.

A NYS property disclosure is required for a single family residential property unless the seller opts for the $500 credit.

So, what you are buying is the issue.  Is it a church now or a single family home?

An attorney is not required, but considering the value of the transaction and potential problems you should have a real estate attorney on your side.  The cost is only around $1000-2000.   Let them have all the headaches.

I am able to answer questions related to buying or selling residential real estate in New York. There are many questions buyers and sellers have about the process of buying or selling a home that they are afraid to ask or that might seem too simple to ask. For instance: in a house, why do some doors open in and some doors open out?
