Buying or Selling a Home/Upon death

Question
My sister has just passed away and left my niece executor of the will.  She has no one else's name on the house.  What will happen to the house.  Can my niece stay in the house and continue to pay the mortgage without refinancing.  How does she get her name added to the house without going through a finance company. Also her name is not on my sister's bank accounts.  Do you think she is going to need an attorney.

I'm sorry for your loss! Yes,your Niece needs to have an ATTORNEY assist her with her duties and responsibilities as the Executrix of your Sister's Estate.

If there's a WILL, I assume that your Sister had it drawn up; by a Lawyer. Your Niece should meet with THAT Attorney over their WORKING together handling the distribution of your Sister's Estate!

The Lawyer will help get the Bank Accounts,Mortgages, Deeds and/or Titles, as well as any or all personal properties left behind!If your Sister's Will DOESN'T say "who gets what," the Lawyer will help determine the Heirs and start a process that makes sure all get an equal share!

For local discussion of this matter, I recommend speaking to your Family Attorney, the Director of the Funeral home that handled final arrangements, and/or the Pastor of your Church.
