Buying or Selling a Home/FSBO and attorney

Question
My husband and I are considering trying either simple FSBO or Rent-to-own.  In what stage will we need an attorney?  Do we need an attorney from the very beginning stage like signing a purchase contract? How about Rent-to-own procedures?  Thanks

Answer
Dear Judy,

Rent to owns don't work, at least not in Southern CA and not in all the years I have practiced real estate.  Why are you considering purchasing a FSBO rather than using the expertize of an agent?  FSBO's represent themselves (which can be dangerous) to save money for them not to pass it on to the buyer.  I recommend you find yourself a good agent to assist you in purchasing a home.  I can't advise you on when to get an attorney as most sales in CA don't use attorneys.  Some states are attorneys and some use escrows.  If you are in an attorney state ask this question of a local agent.

Hope this helps.
