Hello,
We live in Connecticut. We closed on the sale  our home. Our attorney mailed Chase bank our payoff check via Fedex.  several weeks later Chase contacted us to say we still owed our mortgage, that it has not been closed out.My attorney then  discovered that Fed ex lost the check in transit.it was never found. we paid with a new check.  Stamford Connecticut notified us that we were now liable for $4600. in taxes for that quarter that we thought we had closed on already. We agreed to pay, our attorney said it was simple to ask the new owners to turn over  this amount by check to us, since as the new owners they would be responsible for it.  The new owners have refused to give us any money, they say our water well was faulty. It was not faulty and they closed on the house with a clean well inspection with no problems. They still refuse to pay us after 3 years. It is in connecticut superior court now and our attorney is refusing to do anymore work on this case.  Who is liable here?  Thank you.

This question was rejected on 2/18/08. As this is a matter already in Superior Court,answer to your question from anyone other than your  Attorney would be inappropriate!If you need a "2nd Opinion,"or think that your current Legal Representative may be partially liable for your problems, you could see another Lawyer! In any event,the Court will decide what damages you've experienced, if any, and who, if anyone, is liable! Sorry about your "Bad Luck," and wishing you--"Good Luck!" (JR)
