Buying or Selling a Home - Life Estate

Expert: Jim Root - 4/10/2008

Question
We currently have a life estate on my parent's home.  They have agreed to sign the property over to us, in order to refinance at a lower rate (they understand the risks).  What are the financial repercussions of this move - both for us and for them?  Thanks.

Answer
TERRI--

To determine and explain to you and your Parents "the financial repercussions" of their signing over the home to you at this time,is a job best done by a Financial Analyst/Consultant, not someone who's  an Expert in Real Estate matters.

In any case, to determine the impact that the action would have on yours and their financial situation cannot be accomplished without the one making that determination having all of the details needed to analyse your specific situations--ie, your income base and that of your Parents, the value of the home, estate & property  tax implications, etc!

Your Parents likely had an Attorney involved in the Life Estate actions; he/she can either answer your questions or direct you to a CPA-type who can! Suggest you follow up with a visit to the Lawyer--and be prepared to give him/her all the info needed to analyse the situation!

GOOD LUCK!
