Question
My mother passed away last year and when she died she left her house in a friends' name but the house is mine. She just wanted me to have someone looking out for me. Anyway I have a friend that wants to but the house and has cash for it. What process do we have to go through ... do we need a lawyer? or can we handle this matter ourselves? Please help.

No, you can't handle this matter yourselvef If Mom left the home to someone else in their name , even though she wanted you to have it but to also have "someone looking out for" you,it's questioanble if you can sell it! It sound s like the home is not yours, but is legally your Mom's Friend!
You need an Attorney to help you with the matter of actual ownership of the property!If the Frfiend agrees to transfer legal owneship to you, it should be an easy job for a Lawyer--it he/she won't let you have/sell the home, it's going to be a legal "battle!" Additionally you may want to have Real Estate Agent help you with the sale if/when you are able to sell it!

| Comment | Thank you so much and please wish me luck... we did hire a lawyer but no offense, he is really lazy. He said it was going to be an open and shut case because he has everything he needs but now he has said he faxed one of the forms wrong now things have to be resigned and resent and right now my mom's friend is out of town. very frustrating. I wish I would have done a little more homework before I hired this guy. Now that I am up to my neck into it with him it seems like there is no turning back. At $250 per hour now he is saying it "could" cost up to $25,000 to do the whole thing. FRUSTRATING. By the time we are finished with everything I am sure it won't be enough to count for anything.
