Question I am in a legal situation with an insurance company. The claim against me is 55000 dollars. I told them that I have no assets. But when they ran a credit report it shows that my name is on a loan for a house in Idaho. In 2006 I purchased a home in Idaho with a friend as a fixer upper. It didn't work out and I moved out and moved back to California. I did a quick deed to get my name off the title and I thought I was taking my name off 1 of the loans that we had on the house. We had 2 loans at the time. I told her I would keep my name on the bigger loan because she wasn't going to be able to qualify for the loan herself. So I told her I would keep it on there until she could refinance. Well she has not been able to refinance yet. She is in the process but it hasn't happened. Now I have this claim against me for 55000 dollars. I told the insurance company that I don't have any assets because my name is not on that house. But when the insurance company checked my credit they saw my name on this loan for a house. I am wondering if they can take the equity from this house even if it's not my house, but my name is on the loan. But I am not on the title.
Answer LINDSAY--
What a mess you're in! You need more help than any of us at AllExperts can give you. You're in a very complex situation that only an Idaho-licensed Attorney and member of that State's Bar Association can handle for you!
I'm assuming that you can't afford a Lawyer, so here's some info that may help you. Check the Yellows Pages for the closest Office of the Idaho State Bar Association and call them. Most of these
quasi-governmental professional organizations for Attorneys have Lawyers who will do "pro bono" (free legal) work for people like you who are in dire need of legal assistance but can't afford it!
Hopefully, the Bar Association will hook you up with a Lawyer--and with his/her help, perhaps this can get straightened out soon--and to your advantage!
GOOD LUCK, Lindsay!
