Buying or Selling a Home - getting someone out

Expert: Michael McClure - 4/22/2008

Question
in 2000 my boyfriend and i bought a used mobile home. he had bad credit I had great. everything was put into my name. the problem now is we broke up, the home is on his mothers land so I had to leave, he was making all the payments until he got married. Now I am facing foreclosure and garnishment and he is still in the home racking up the past due amounts with no worries on him. my question is what are my options? how do I get him out and to pay up what he owes

Answer
Hi Kim....this is way out of my league!  When a home is placed on a permanent foundation, it becomes "real property".  The lender needs to know what's going on, and probably advise you.  My guess is that you will have to do an actual eviction, but I don't know real estate law....sounds like a real mess....sorry for you.  Who ever said "love sucks" couldn't have been more accurate!   "~ Michael
