Question i have a contract as the seller, i now have cancer and want to keep my house, any recourse for me? the buys doesnt want to settle for another 3 months and I want to keep my home
Answer Hello John,
I am sorry to hear about your bad news.
Unfortunately you are in a legal contract and if the buyers perform all their requirements you will have to also unless your lawyer can find something in your contract to get you out of the sale.
If you really want to try to stay in your house just don't set up a closing. The buyers will pester you and your lawyer on and on and threaten and pester. If you refuse to close the buyers will have to sue you in court to close. That will cost money and time. They may decide not to do that and walk away. Then you can stay in your home.
If you only want to stay in your house an extra 3 months you should be able to drag it on that long without their consent, but they might walk away.
Ask your lawyer to look at the contract first. If there is nothing in it you can work out then tell him you will refuse to close for 3 months or what ever your goal is and to be prepared for that.
