If a homeowner gives me Power of Attorney to sell his property, do I still need a Real Estate License?

Hello-

This is an excellent question.  You haven't told me what state your in, but according to MA laws, I know that a home owner can sell their own home without a license. I would think that ultimately the power of attorney means that the owner himself is selling the property, so I would think this would be legal.  However, I would recommend that you talk to a real estate attorney, or other legal rep, as I also think that such a situation could leave you open to numerous legal issues, including disclosure issues, advertising issues, and others.  If you intend to collect commission through this process, than I think it would be reasonable for the state to feel that you are operating as an unlicensed real estate broker, and that could cause everyone problems.
