Question
I have a ratified contract.  What recourse do I have when a
realtor has sent me an e-mail stating that the appraisal
contingency is time specific (21 days) and took his word
and now that we are almost at the end of the process tells
me that he misspoke and it is not time specific and that
the appraisal could take as late as before settlement.

Hi Gloria-
Thanks for your question but I'm not sure what your goal is? I understand that the agent made a mistake in what he told you but is there a problem or are you just upset with him? I know this is a stressful time and you relied on him to "take care of you" but the bottom line is your contract- what does it say? That is what a judge would go by. I am not saying you don't have an issue or that you don't have some recourse but it is also your responsibility to read and understand your contract or to seek counsel if you don't before signing. That being said, you can certainly file a complaint with his local realtor's board and or the licensing agency for your state and include the agent's broker. If they find him incompetent, they can fine him and suspend or revoke his license. Most likely, everything including the appraisal will be fine but I can certainly understand your concern down to the wire. Best of luck and I hope this helps, Toni
