Question
my husband and his brother own property together. his brother doesn't want to sell but my husband does.
the property is in the state of ohio, licking county, newark

Dear Jayne:  You are in an uncomfortable position.  But you should be aware that there are processes for just this situation, but it cannot be handled initially be a real estate agent.  You should go through a real estate attorney the first thing, who can explain your options and how they work.  When the legal stuff is handled, then the real estate agent kicks in. Laws are different from state to state, and I am in California.  YOu need good professional support plus since it is a brother/brother relationship, a neutral third party is best.  I hope that this does not destroy a family friendship, but if handled with dignity, perhaps it will not,  But I am interested in knowing what you mean by "licking county".  It is a cool phrase, and I know I would enjoy hearing what it indicates.  Please let me know how this turns out, and if there are questions I can answer or help you with in the future.  You could also check out neighborhood storefront legal services offices that offers different programs at less the cost that an attorney from a legal firm.  However, if it gets complicated and the brother is not cooperative, then you need to best and the best is usually worth the money.  It is as important to keep the family together as it is to reconcile this issue.  Good luck!
