Question I am in a process of closing escrow. I purchased an REO condo owned by fannie mae in South California I performed everything I need to do by my end--including signed loan docs & all the escrow papers and deposit all the down payment. But I can't close escrow on time because HOA hasn't sent back the HOA certificate to Escrow. Escrow officer said she has been contact HOA for many days and didn't get any reply. In this case, who should be responsible for the delay? If HOA kept delaying, what we could do? Anything we can do the push HOA to send HOA certificate? Please advise. Thanks in advance.-----An upset first time buyer.
Answer This is a very new scenario for me, so this is my opinion having not been in this situation before. I would PERSONALLY get the contact info for the HOA and make a visit myself (or have your agent do it). Let them know that if there are damages as a result of their delay that you will take them to small claims court. That should get them moving.
