Question
Hi Connie,  My husband and I are buying a home in Florida.  I will be going down to sign papers, my husband cannot make it.  Is there a way to get his signature on the papers even though he is not there?  Can the documents be faxed to him and then he can sign and fax them back?  Or is there any other way this can be done?  There will be no mortgage, but we want both names on the ownership of the home.

Hi Linda...

Congratulations on purchasing a new property...  I assume you are speaking about the title? the Deed?  Fax signatures on documents that must be recorded and not allowed (at least not here in California) the original must be taken to the country for recording... you can be his power of attorney... have your lawyer or title/escrow department prepare the doc, get his signature notarized and you are good to go...

PS.. you can always add him to title later too if that makes it simpler for you ... adding someone to title is simple... removal can be a different story...
