Question
Hi Doick,
My four siblings and I inherited a home in Florida from my parents.  The property was recorded as a distributive deed and states that we are fee simple owners.  Two of my siblings and I would like to sell our percentage of the property to an outside buyer, due to rather contentious interactions with the other family members.  Can we?

Answer
As long as you are fee simple owners of your share of the property, you may dispose of it in any fashion you choose. Just make sure the people you sell it to know that what you are conveying to them is only a share of the property. However, I strongly suggest you have a real estate attorney do it for you. This way, you will know it is done correctly and there will be no backfire on you. I do wish you well.

Expertise

With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot. Also, ask about my hard-copy newsletter, The Landed Gentry. It can also be sent to you via PDF.
