Question
Just last week, my husband and I placed our house for sale with a realtor.  Just 2 days ago, my brother in law sold his house.  He has wanted to buy our house but had no real prospects for selling his until 2 days ago.  He is will buy our house for the asking price, but can he buy it without us using the realtor so that we could save those fees.  Someone told us that there is a clause in the contract to allow family members interested in buying from family members to forfeit the contract so that we could sell to him for full asking price and not be charged all of the realtor's fees.  is this the case?

Dear Becky;
I suggest that you read over the contract and look for the clause that you are referring to.  I have no idea what your contract says but if there is nothing mentioned in the contract then you will owe a commission to the REALTOR who listed your home.  One note...just because it is a family me3mber who wants to buy your home, doesn't mean you shouldn't have a professional handle the sale.  There is nothing worse than having a dispute over something with a family member.  A professional will make sure that all inspections are made and that the offer and ensuing contract is fair for all parties involved.
