Question
I am an owner of a second home in joint tenancy with my nephew.  I want to give my portion of the ownership to him, so no money will change hands.  Do I need to use a realtor for the transaction, or some other professional?

Dear David;

Thank you for your question and your patience for my response.

No you do not need a Realtor for this type of transaction. Contact a title company in your area and ask to speak to an escrow officer. If you remember who you used when you acquired the property, use the escrow officer who handled your transaction. You would want to tell them that you would like to “Quit Claim” off the property. The title company will have the proper document to allow you to do this. The only cost for this is the a potential notary fee and recording fee for the county. If there is a loan involved, and you are on the loan, this would not relieve your responsibility to pay the loan off, even if you were deeded off the property. You also should be aware that this could considered a wrap around loan at that time which is not legal and if the lender becomes aware of it they can call the loan. Please realize that I am a Realtor and not an attorney offering you legal advise. I am recommending that you consult with a real estate attorney prior to the execution of the "Quit Claim"

I also recommend you to consult to your CPA prior to doing this to determine if there any tax issues you or your nephew could be confronted with in the future. I hope this of some help to you… Good Luck!
