Buying or Selling a Home/child support judgement

Question
QUESTION: I'm in New Jersey and on my credit report I remember seeing a child support judgement and a couple of credit card judgements...I'm selling my house  and at closing will I be forced to pay these with the proceeds of my house ???

ANSWER: Hello Mile.
Thank you for your question.
It is entirely likely that the child support judgement and credit card judgements have been converted to liens on your property.  In that case they would need to be satisfied/paid/settled in order for you to sell/pass title on your house.

Maybe you can negotiate settlements on the judgements that are lower than the amount they want.

QUESTION: how do I find out if my child support judge and credit cards have they been converted to liens against my real estate property?

Answer
Hi Mike,
Thanks for your question.

You need to have a title search done.  That will reveal all liens on the property.  When you are selling your house the buyer will get a title search.  The bank will not lend money for the purchase unless the title is clear of all liens.

I am able to answer questions related to buying or selling residential real estate in New York. There are many questions buyers and sellers have about the process of buying or selling a home that they are afraid to ask or that might seem too simple to ask. For instance: in a house, why do some doors open in and some doors open out?
