IS IT LEGAL FOR A REAL ESTATE AGENT TO PUT 2 BIDS IN AT THE SAME TIME FROM TWO DIFFERENT CLIENTS ON THE SAME HOUSE BEFORE THE BANK HAS ACCEPTED  OR DECLINED EITHER ONE

Thank you for your good question.

Yes it is, although ethically the Realtor may want to disclose the situation to each of the clients prior to writing the offer. If the Realtor is representing the Bank in the sale of the property, it is their obligation to present any and all offers if they are written at the same time or even after the other offers are presented to the bank. As long as an offer has not been accepted by the bank, they are obligated to present any and all offers to the bank as mentioned. The Realtor must not disclose each of their client's terms and conditions of their offer. The Realtor can advise you as to what terms and conditions would be best suited for your offer other than the price. You would be the one determining the offered sales price based on your knowledge of the property and your desire to own the home.

If the Realtor is representing the Bank, you do have the right to select another agent for the job of representing and writing an offer on the property. It would need to be in the local MLS and the Listing Broker would have to be cooperative which most are.

I am a Realtor in California, and with the little amount of information you provided, I am limited in my advice to you. I would also recommend that you contact the Realtors Broker Manager of your Realtor's company to get the proper information which they are obligated to provide.
