Buying or Selling a Home/mineral lease bonus

Question
I closed on my home on 3/5/2007. In the contract, I leased the property to the previous owner until 3/28/07 so that he may have time to relocate. On 3/6/2007, the previous owner signed a mineral lease and received a bonus check of over $3200, while in the closing documents all minerals were transferred to me at closing on 3/5/2007. Since the previous owner was clearly in negotiations of a mineral lease prior to closing, does this constitute a Failure to Disclose violation since I had no knowledge of any such negotiations. Thank you for your time with this matter.

Hello Larry - Clearly if the deed conveyed to you indicated the mineral rights were to convey to you, and prior to, during or after you entered into contract and subsequently closed, the seller entered into a contract that if it closed would have altered your interest in teh property and/or mineral rights... you probably have a legitimate complaint. I am not an attorney therefore this is not to be considered legal advice and I cannot ensure you that you do have such a position. I recommend you immediately seek a 'real estate' attorney to review your situation. There may be other violations as well. Thank you for the timeline.- Todd
