Question
I live in SD we just listed our home, when we asked how much time (days) do we have to pack up and vacate the agent said after closing.  How can this be?  When we closed on our home in Denver we had 72 hours to pack and let the buyer take possesion.  Don't we have more than closing to pack and move, we have horses, dogs & chickens to move not to mention our furniture and belonings, and vehiciles.  Is there a specific time line that allows the seller to move and the buyer to take possesion?  Please let me know and refer me if you can to the standard process, are the laws different from state to state?

Dear Diana;
Laws and practices differ from state to state, so you should carefully discuss moving procedure with your agent.  Of course, you will need time to pack up but usually this can occur slowly over time.  You can begin boxing unused items now and once closing occurs you will have less work to move the remaining household.  In our area, moving occurs before the closing so once papers are signed the buyers can move right in.  However, as I said that is not always the case in all areas of the country.  

If you go over your moving schedule with your agent and find that the time allowed for this is not acceptable you might need to draw up an addendum or amendment to the contract to allow for more time after closing.
