Hi Connie,


I'd like to get your thoughts on the following issue:

I am scheduled to close on a house this Tuesday.  The seller has not responded to all my questions and will not be present at the walk through to do so.  Nor will their agent.  They said they would be available right after the close as they are coming in from out of town (which I have my doubts on).  

My position is I do not want to have to rely on the good will of people I do not know.  If that means pushing the time of the close back to later on in the day then that’s what I’d like to do.  But I want complete information on this house before I close.

There are many issues you don't expand on...

1. Do you have an agent to represent you?
2. Did you have an independent inspection?
3. Did you receive disclosures from the seller?
4. Did you have an appraisal?
5. What are your major concerns about the property that are causing you pause?

These are just a few... with out more? it is hard to answer.. I close properties every day where the buyer and the seller never meet or have any idea who the other person is... however, the seller signs documents, hands over information of knowledge about the property, the buyer has inspections, and that is not limited to the physical inspection only... could be anything from foundations to geological, permits, code issues, neighborhood issues, Megans law etc...

if the seller has not preformed to the contract you have, they are in breach of contract, you have every right to hold the funding until you get the answers you are looking for.. contact your agent or attorney and get the demands sent to the seller in writing and hold your ground if the issue is that important to you...

You will have little recourse if you close and find out the seller de-frauded you... proving things in court is harder than you can imange... right now is the time you hold the power...
