Question
I learned that my deceased husband had forgotten to put my name on the deed of a house I now need to sell. Since his will was not probated I found that I only owned half of the property and my husband's eight children owned the other half. All but one signed quit-claim deeds to the property. But one son has been completely out of touch with all the family for a long time. The title company has sent mail to his last known addresses with no help. The underwriter for the title insurance has refused to insure the title. We thought we might be able to hold in escrow whatever amount this one son would receive. But we have been refused any help. Is there something we can do now? This son could be dead for all we know. I need to sell the house very badly.

Hello Lois - This took me a while to gather the information from a trusted legal source in Arizona. You must seek an attorney to resolve your dilemma. One way to accomplish this is to file the court documents and do service "publication" Arizona, if you cannot serve someone, or if US Mail is returned to sender undeliverable you can legally serve them by publishing the court notices in a paper of regular circulation at the last known location that he lived.  You can then go to court and show that you followed all of the service requirements by publishing in the paper and the court can issue a default judgment on your behalf.  But all of this will require doing it through the courts, and service by publication takes a least a month to do (because you have to put in the paper every week for 4 weeks I believe). Of course if you live outside AZ then you will want to take this information and provide it to your local counsel and inquire as to whether this is possible in your state and the local process specific to your state.
