Question
my property is in my name alone my husband took his name off by way of quit claim deed
i have a buyer for a piece of this property and the lawyer has put my husbands name back on deed and wants him to sign the problem i am having is my husband got hurt in a wreck and can not move from neck down spine injury and cannot talk head injury he is on a ventilator to breath i want to sell this property without my husband having to sign help

Hi Pam,

I am so sorry to hear about your husband... you will most likely have to get a court appointed guardianship to proceed with this... I am surprised at this point that the lawyer had his name re-installed on the deed..

as you can see it is always simpler to have a name put on that off, as off requires acknowledgement from the party involved....

your lawyer should be able to get the court papers necessary to give you all power of attorney over your husbands affairs, or if he had a will designating someone else you will have to get their cooperation... Good luck

PS ... inform the party that wishes to purchase and be up front... they will most likely wait if the the price is good...
