Buying or Selling a Home/Someone trying to sell a house that's been sold??? maybe???

Ridgemoor Rd. - Sun Ci
I responded to an ad on Craigslist for "owner will carry" list-
ing; my creit is fabulous, but I can't get a loan because I'm
underwater (altho' current) on my mortgage. Here's what I think
happened. I called the # in the ad, left a message. Guy called
me back, I talked to my husband. I sent him an e-mail asking for street addy so I could do a drive by.  However, I did a little checking on the Internet %26 this is what I found: SALES IS PENDING thru a Cent 21 agent for about $25k less than the pending sale price.  I've got half a mind to call the Cent 21 agent to let her know what's up. Pissed me off. I haven't gone back to this guy to ask him why he's trying to sell a house that's already been sold. What do you suggest I do about this?

Unfortunately, Ann, there are indeed a few real estate agents who are less than honest. What that guy obviously was trying to do was to find buyers. Presently, agents are having a heck of time trying to find legitimate buyers. So, he puts down an address in Craigslist, Realtors or whatever site has listings for sale, any address, and he then shifts the buyers over to what they are really looking for by asking them questions. Surprise, surprise "he discovers" that the property has a contract on it. So, then he works on the buyer and hopefully is able to sell him something else.

If it was me, I would find another ethical real estate agent and tell that person that I was willing to pay more for that listing. The banks (if that listing is an REO) are very unethical these days and think nothing about cancelling an existing transaction if they smell a higher price somewhere. If that ethical agent you find tells you he/she would rather find you something that is more apropos, then you know that agent is REALLY ethical, the way it should be. If that pending sale is a regular transaction (no foreclosure or short sale), then chances are you would never be able to put in a good offer unless you want to submit a "backup" offer.
