Buying or Selling a Home/Failure to Disclose

Question
I just found out the house I purchased has a known defect. the previous owners signed documents that indicate they never had any issues involving the defect. However, I began to get notices from my HOA regarding an improvement on the property made by the seller. Apparently, it was never approved when he signed documents stating they were. What do I do now? If I had known I would have never bought this property. Now I am responsible for this mess. Please help.

Answer
Did you have a Buyer's agent?  The listing agent should have provided a Seller's Disclosure and if it wasn't on there, and you can prove the seller knew it, then the seller is liable. Ask your attorney.  He can look at your documents you signed and tell you, so could your Realtor.
