Buying or Selling a Home/Insulation in 1960s home

To sell a house in Washington state that was built in the 1960s, do we have to update the insulation in the attic and crawl space to meet current building codes?  The attic currently has 4 inches of insulation and the crawl space under the house has none.

Hello Bill - A property does not need to be brought to code. Although inspection companies must indicate that the code has changed and usually state the new code as a recommendation (i.e. GFI outlets in wet areas). Todays construction process is to staple measurement markers in the attics so an inspector can identify the depth of the blown in insulation for that type of use. Remember loose insulation settles and therefore even though the "R" rating will still exist the depth is compressed over time. If you know of a shortcoming in the insulation because it was brought to your attention a roofing or HVAC technician, then disclosure laws require you to disclose that to the buyer.. but you would probably not have to increase the material unless it was negotiated between you and the buyer. If the area under the home is typically insulated in your construction codes (all states and climates are different) then again you're required to disclose this but don't necessarily have to repair it. Again, unless negotiated in the offer/contract. Check with a neighbor who has a similar home with crawlspace and ask if they have the insulation. You could also check with a local builder for cost estimates (for negotiating) and to verify code to see if your property meets the requirements. If you purchased the home in this condition and it is determined that there must be insulation under the home then possibly (if it falls within the statute of limitations) the person who sold the home to you may have some liability... and so might any agent involved in that transaction. If you discover the seller who sold it to you may have failed to disclose then I recommend seeking a real estate attorney for details and a complete understanding of your rights.
