is it illegal to sell a house in ohio without disclosing that it has a broken sewer lins under it and an open sewer line

Any time a Seller has knowledge about a home that is significant information and/or a material fact that might affect a Buyer's decision to make an offer on a home or even how much to offer on a home; it is essential that this information be disclosed to the potential buyers and their agents.  It is also important that the Sellers disclose anything of this nature to their listing agent if they are represented.  They run the risk of legal actions if they hide important information.

I don't know the specifics of the particular situation, but it also seems to me that there were some extenuating circumstances where (perhaps) the utility company was involved.  Perhaps the sellers were seeking assistance and were made promises that this would be fixed before the sale.  All of this is still no excuse for a non-disclosure.  Buyers should be informed of existing problems and then informed of what remediation plans have been made.
