Question
I purchased my home 3 years ago in Wa. state. I was the first of many homes built in my subdivision. In my covenance it states that no home will be built under 1700 sq. ft.By builder is now building 1400sq.ft. homes to finish out the subdivision. Do I have any recourse in this matter?

Answer
You may want to first contact the builder, Charles, and ask about their overlooking the covenant you apparently have connected to your deed. Be sure to talk with the president of the company or the company's legal department. If it has not been satisfactorily explained, I would recommend you consult with a good local real estate attorney. The attorney should be able to explain it to you, or get a settlement satisfactory to you. Just maybe you may be misunderstanding the covenant. Perhaps it refers to your property only or certain portions of the subdivision. I do wish you well, Charles.

With more than 41 years as a real estate broker, I can solve most any problem presented. If I can`t, I do my research. Problems with mortgages, trust deeds, foreclosures, odd ways of conveying titles. Most any good Realtor can answer questions satisfactorily, but I answer questions that most cannot. Also, ask about my hard-copy newsletter, The Landed Gentry. It can also be sent to you via PDF.
